CONDITIONS
OF HIRE
BOOKING
A boat is
not booked until the completed booking form
together with the required deposit has been received by the company and
the hire confirmation issued to the hirer.
BALANCE
OF HIRE
The hirer upon making a booking becomes responsible for the whole of the
hire fee and the balance must be paid at least 6 weeks prior to the
holiday commencement date. Bookings made less than 6 weeks before the date
of the holiday must be paid for in full at the time of booking You may pay
by cheque or card.
CANCELLATION
SCHEME
In the event of a cancellation 60% of your deposit will be retained by the
company, and every effort will be made to re-let the boat, how ever if the
company is unsuccessful in re-letting the hirer remains responsible for
the full balance of hire. We will send details of the cancellation scheme
with the acknowledgement of your booking, and unless you already hold this
type of cover, we do strongly recommend this to you to safeguard your
balance of hire against unforeseen cancellation.
HIRERS
Bookings will not be accepted from hirers less than 21 years of age.
All boats must have minimum of 2 physically and mentally able adults, 18
years or over.
RETURN OF BOAT
Boats must be returned at the end of the cruise in a clean condition
and vacated at the agreed time. The hirer is responsible for allowing
sufficient margin of time for contingencies, The company reserves the
right to make a charge of £20 per hour for cleaning a dirty boat, or for
late return, plus any additional expenses incurred by the company as a
result of the late return.
INSURANCE
The owners insure the boat and its equipment against public liability
risks. The policy does not cover personal accident or the hirer’s personal
effects, and the hirer is strongly advised to check his own insurance
agreements. A Damage Waiver premium is added to your final invoice This is
a single non refundable payment which covers you for any accidental damage
or loss to the boat and its equipment whilst on hire to you.
Costs resulting from speeding, negligence, deliberate damage to the boat
and its equipment, waterways equipment or to a third party are not
covered.
ACCIDENTS
The hirer is in complete charge of the boat and is responsible for its
safe navigation. In the event of any accident the hirer must notify the
company at once with full details and names and addresses of any
witnesses. DO NOT ADMIT OR ALLOW ANY OTHER PERSON TO ADMIT LIABILITY UNDER
ANY CIRCUMSTANCE.
In the event of an accident the company may repossess the boat and the
hiring contract will then terminate without liability on the company.
BREAKDOWNS
The hirer shall notify the company immediately by telephone in the event
of breakdown, damage, theft or loss and shall provide full details and
comply with the company's instructions The hirer must not undertake or
have undertaken any repairs adjustment or service with out the company’s
prior approval.
UNSUITABLE HIRERS
The company reserves the right to refuse to hand over the boat to any
person, who in their opinion is not suitable to take charge. In such cases
all hire charges shall be refunded in full and all liabilities of the
hirer and the company will cease; the company also reserve the right to
decline to accept any booking without giving any reason.
NAVIGATION
No boat may tow another, travel in the hours of darkness or enter tidal
waters. Minors must not be allowed to navigate boats unless an experienced
adult is standing alongside so that they can take over in an emergency.
No boat should be occupied by more than the booked number of people unless
previously agreed with the company
BOAT AVAILABILITY,
RESTRICTIONS AND DELAYS
If due to circumstances beyond it’s control, the company is unable to
provide the hirer with the boat booked or a suitable alternative, the
company will refund all hire charges paid in full and will have no further
liability The company accepts no liability and is not bound to make
financial adjustment in the event of cruising waters being restricted,
through repair work, storms, ice, shortage of water and any other cause
beyond the control of the company. Similarly the hirer shall have no claim
upon the company as a result of any failure of the boat or equipment.
CAR PARKING
Vehicles may be left entirely at the owner’s own risk at our boatyard. The
company will be under no liability for any loss or damage to vehicles or
their contents.
